General:

You the customer are responsible for the correct spelling of text on the customised labels. DeVine do not accept any responsibility for any mispelling or the quality of the photographs uploaded. The photographs of the wine to be personalised are for illustration purposes only and will not necessarily be the actual bottle purchased.

Age restriction:

We won't sell alcohol to anyone who isn't 18 years old or over. By placing an order you confirm that you are at least 18 years old - the recipient must also be over 18 years old. If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the wine is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the wine.

Customers should also be aware of the following inherent risk and warning:

- Alcohol should be consumed in moderation

- A case of wine or other boxed items supplied by DeVine can be deceptively heavy so extra care should be taken when lifting.

- Red wine in particular may cause staining if spilt so extra care should be taken.

- Sparkling wines and champagnes can be volatile due to the build up of gases so extra care should be taken when opening these

Ordering:

All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

Product:

We reserve the right to alter any details or design of products illustrated without prior notice and while every effort is made to describe our goods accurately on sales literature, email and the website no warranty is given as to accuracy and no responsibility will be accepted for error or mis-description and any resulting loss.

Online payment:

All online payment transactions will be processed by Streamline, which authorises a secure online payment system through www.worldpay.com. Card and transaction information is not kept by DeVine and consequently will not be shared or disclosed and will only be used to process orders. Credit/Debit card payments can be made using Visa, Visa Electron, Maestro, Solo, MasterCard, Delta, American Express and JCB. Gifts will be dispatched within 2- 7 working days of receipt of full payment.

Prices: Where applicable all prices are subject to V.A.T. at the current rate.

Quotations and contracts:

Orders are accepted subject to our right to adjust prices quoted to take account of any changes in the law or Government regulations requiring us to increase prices by way of direct taxation, import duties, customs and excise duties or otherwise. The prices are based on today's current costs of production and in the event of any increase in wages or costs of materials to us occurring after the confirmation or accepted contract, we shall be entitled to charge such increases to you.

Delivery and lead times:

Items that do not require engraving will normally be dispatched within 2 to 7 working days from date of artwork “sign off", unless otherwise stated on the website. Engraved items will normally be dispatched within 2 to 14 working days from date of artwork “sign off", unless otherwise stated on the website.

Deliveries to the Channel Islands, the Scottish Islands, Scottish Highlands, Isles of Scilly, Isle of Wight and the Isle of Man can be arranged, along with deliveries to countries within the European Union & USA can be arranged at extra cost, for further information contact our customer services team.

Delivery charges, as shown below, include postage, packaging and delivery to all mainland UK (Northern Ireland, Wales, Scotland & England) addresses through Western Couriers or Royal Mail Recorded Delivery. Delivery costs are per delivery address NOT per customer order.

Western Courier Service Delivery:

All deliveries require a signature, where the recipient is unavailable at time of delivery the courier will leave a card & will try and deliver again. Should there be no-one to collect the parcel on the second attempt, the parcel will be sent back to the depot and re-delivery will incur another delivery charge to be paid before the goods are sent back at out. Alternatively, customers can arrange to collect their parcel from the depot themselves.

Passing of title and risk:

The risk of the goods shall pass to you on delivery. All goods, delivered or not, remain our property until payment is received in full. Until such time as payment in full is made, you shall retain such goods separately from other goods and clearly mark them in such a way that they can be readily identified as being our property and any payment received by you for any sale of such goods must be held in a separate account in trust for us. In the event of non-payment by you for such goods we will, without loss of any rights or remedy, remove from your possession those goods belonging to us in accordance with these terms and conditions and we shall be entitled upon the property where the goods are stored and repossess and remove the same. You hereby grant us irrevocable licence to enter your premises for the said purpose.

Claims:

Claims arising from damages, delay or partial loss in transit must be made in writing to us, so as to reach us within 5 days of delivery. All claims with regard to the quality or quantity of the goods shall be made in writing to us; so as to reach us within 5 days of receipt of goods or such goods shall be deemed to comply as to quality and quantity with the terms of the contract. You must examine all goods delivered at the time of delivery. We shall not be liable for any loss or damage caused to the goods in transit unless loss or damage is noted at the time of delivery.

Liability:

Save in so far as defects in the goods cause death, injury or damage to personal property, our liability for any loss or damage suffered by you in respect of the goods shall be limited to the contract value of the goods. We can accept no responsibility for loss or damage arising from the supply of goods under this contract unless you have fully complied with the notification of claims procedures. Nothing in these terms and conditions shall affect the right of a consumer.

Cancellation charges:

A charge will be made on all cancelled orders, together with the charge for all work carried out up to the date of written cancellation. Personalised Goods and Goods which are made to order cannot be refunded, returned or exchanged.

Changes to artwork:

In order to print efficiently from the artwork you supply, it maybe necessary to adjust or redraw your artwork. You will be advised of the changes made and any additional charge applicable. No printing will take place until DeVine has received in writing your "signed off" approval of the artwork.

Colour variations:

Due to the variety of materials, the printing processes utilised by DeVine and its suppliers no guarantee can be given to match exactly pantone numbers or colour samples provided by the client. DeVine will endeavour to match as closely as possible to these colour references but cannot be held liable for any further costs that may arise.

Print quality:

DeVine will endeavour to maximise the best quality reproduction of all photographs and artwork supplied. However due the varying levels in the quality of photographs and artwork supplied online DeVine and its suppliers can offer no guarantee of the final print quality on any product and cannot be held liable for any further costs that may arise.

Force majeure:

We will not be held responsible for failure or delay in the carrying out of our obligations under the contract arising out of any cause outside our reasonable control or by inability to procure materials or articles except at higher prices due to any such cause and in such circumstances we shall be entitled by notice to terminate the contract in whole or in part without incurring any liability to you.

Availability:

Wine is an agricultural product and runs out from time to time. In certain circumstances we may change some specified wine orders, but we never use this as an opportunity to advertise a good wine and supply plonk. If you ever have cause to disagree with our choice of replacements, we will give you a credit for any of the bottles that we have switched, no questions asked.

Limitation of liability:

Nothing in these terms and conditions shall exclude DeVine liable for personal injury or death caused by its negligence. We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:

i. Loss or damage was not foreseeable to both parties when the contract was formed;

ii. Loss or damage was not caused by any breach on the part of the supplier;

iii. Loss or damage relates to business and/or non-consumers.

iv. Loss or damage caused by the customer handling the wine. In particular we will not be liable for spillages or breakages.

Data Protection:

By providing your details to DeVine, you consent to us maintaining, recording, holding and using the information you give DeVine at the time of ordering to process your orders, to improve our service to you and inform you of promotions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.

Privacy Promise:

We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your wine to you, e.g. our delivery company. From time to time, DeVine may send information about discounts, promotions and personalised offers, unless you have told us not to do so in writing.

If you opt-out from hearing from DeVine or third parties, you will only be contacted by DeVine or DeVine Wines if our terms and conditions change.

Copyrights:

All designs, texts and graphics on this site belong to DeVine. As a visitor/consumer of DeVine you are licensed to electronically copy or to print portions of the website for your own, non-commercial use. Any other use of materials shown on the site without Devine’s prior consent is strictly prohibited.

Definitions:

"Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;

"Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;

Conditions:

Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer. These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer. Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.

Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
